- My eStamp vendor affixes a stamp receipt on the agreement instead of the actual stamp paper. Is that valid?
No. A stamp receipt cannot substitute the actual stamp paper. As per the Indian Stamp Act, stamp papers from government-authorized stamp vendors should be used instead of stamp receipts or self-generated, fabricated copies of official stamp paper.
- If the stamp paper is attached to the agreement PDF, does the stamp paper itself need to be separately signed?
Technically, stamp rules don’t require signing on the stamp - it’s often an internal compliance requirement by companies to ensure a stamp can’t be reused.
In a digital flow, eSign is affixed to the entire document, instead of pages - so whether you put eSign visually or not on the eStamp paper - it doesn’t matter.
To prevent reuse of an eStamp - Physical stamps are defaced with a unique Stamp Serial No. and Document ID, and only then scanned and made available as eStamps.
- If we are switching to digital revenue stamps, do we still need to maintain a repository of physical revenue stamps?
Yes, physical copy of the eStamp might be required during audits or enforcement
- Can eStamp papers be procured in real time?
You can procure eStamps in real-time via NeSL. For any State where NeSL isn’t present or a product where you can’t use NeSL, you will have to procure physical stamps, deface them and then scan them for compliant eStamping.

- Can the stamp paper carry only the second party’s name instead of the first party’s name?
It’s mandatory to have the First Party name as per the Indian Stamp Act
- Are BharatStamps by Leegality “private stamps” that replace SHCIL stamps?
No, you can’t replace SHCIL with Leegality. SHCIL is the government authorized eStamp vendor, while BharatStamp is a service layer on top of SHCIL so your business can procure and affix eStamps easily.In States where SHCIL is generating physical stamps, Leegality also procures stamps from SHCIL vendors and then digitizes them.
